TERMS AND CONDITIONS
The following conditions govern the course of the Screenshots for 2 Contests (‘contest’) as organised by Gameforge 4D GmbH, Albert-Nestler-Straße 8, 76131 Karlsruhe, Germany (‘Gameforge’).
1. Participation Period
The contest starts on 1/2/2016. The ‘deadline’ for entries is 7/2/2016.
2. No Entry Fees
Participation in the contest is free and is not bound to the purchase of any goods or the subscription to a fee-based service.
3. Eligibility
(1) All users (‘user’) of full age with a personal, active account (‘account’) for TERA (‘game’), the online game offered by Gameforge, are eligible to enter.
(2) Employees of Gameforge or companies associated with Gameforge, or spouses and relatives thereof, are not eligible to participate.
4. Participants
A ‘participant’ is every eligible user (‘user’) who submits an email (‘submission’) to screenshots@tera-europe.com with the subject line Screenshots for 2’ before the deadline, in accordance with the following conditions:
a) The submission must contain a screenshot of the game which exclusively displays the participant’s character along with the character f another user who has agreed to the submission (‘submitted combination’) in front of any background.
b) Neither personal details of any kind, the interface nor contents not related to the game may be visible on the screenshot.
c) Screenshots may be submitted in .jpg, .png or .gif format with a maximum file size of 6 MB. File format and size may be altered to conform to this requirement, but any editing beyond this is not permitted.
d) The submission must be sent from the email address associated with the participant’s account and contain the names of the characters displayed and the name of the respective game server.
e) Each participant may send only one submission. Similarly, submissions which contain a previously submitted combination will not be considered.
5. Winners
(1) Gameforge will select 20 screenshots from amongst all eligible submissions by 8/2/2016, on the basis of their creativity and originality (‘selected submissions’).
(2) Gameforge will publish the selected submissions in the forums. Registered forum users will each have one vote which they can give to one of the selected submissions via the forum voting function by 11/2/2016. The use of multiple forum accounts for this purpose is not permitted.
(3) The five participants whose submissions thus earn the most votes are the ‘winners’.
(4) If multiple participants receive the same number of votes, Gameforge will determine the respective winners by drawing lots.
(5) Gameforge will announce the winners on the forums and the channels maintained by Gameforge on Facebook and Twitter, using their nicknames and a reproduction of their submission, on 12/2/2016, and inform them of their win via an email sent to the email address used for the submission (‘notification’).
6. Prizes
(1) The winners’ prizes consist of two coupons for the game to the value of 10 EUR each which will be sent by email together with the notification.
(2) A cash disbursement and/or payment of the prize in goods, or the exchange and/or transfer of the prize to third parties is excluded in each case. This excludes the transfer of a coupon from the respective winner to the user whose character is depicted in the submitted combination.
7. Disclaimer
(1) Gameforge, its bodies, employees, and subcontractors are liable exclusively for willful intent and gross negligence, regardless of legal basis, and in cases of ordinary negligence, only for the violation of essential contractual obligations and limited to foreseeable damages, as far as not precluded by other compulsory statutory provisions.
(2) These limitations do not apply for the loss of life, personal injury or damage to health.
8. Declaration of Consent
The participants consent to their notification in accordance with Section 5 (5), as well as the delivery of the coupons in accordance with Section 6 (1), in the case of a win.
9. Data Privacy
(1) Gameforge will collect, use and process the personal data of the participants solely for the purposes detailed in these Terms and Conditions and in accordance with data protection regulations.
(2) Further information regarding Gameforge’s handling of personal data can be found in the Privacy Policy[CM2] .
10. Other
(1) The participant agrees to these Terms and Conditions with their submission.
(2) In addition to these Terms and Conditions, the General Terms & Conditions and forum rules also apply (together the ‘rules‘).
(3) Should a participant infringe upon the rules during the contest, or such an infringement by proven thereafter, their eligibility may be revoked.
(4) Gameforge reserves the right to end the contest at any time, if for technical or legal reasons its proper execution cannot be guaranteed.
(5) In the event that any individual provisions of these Terms and Conditions become ineffective, the remaining provisions shall remain effective and binding. Statutory rules shall take the place of the ineffective provision.
