    The 10 winning entries to this Fan Art Competition will be implemented as loading screens in TERA for the summertime. Simply create your digital TERA masterpiece portraying the summer season in Arborea and follow the steps detailed further below!

    • Read and accept the Terms and Conditions.
    • Design an original piece of digital art with the following theme: “Summer in TERA”.
    • Submit your piece of digital art – in either .BMP or .PSD format with a 24-bit resolution and dimensions of 1920x1080 at a maximum size of 6 MB – to the following email address: contest@tera-europe.com.
    • Use the email address for your present TERA account and add the following information to your submission:
    1. Subject: “TERA Summer Contest”
    2. Name of your character
    3. Name of your server


    Final submission date: 21/6/2020 at 23:59 CEST.

  • Terms and Conditions


    The following conditions govern the course of the “TERA Summer Contest” (“contest”) as organized by Gameforge 4D GmbH, Albert-Nestler-Strasse 8, 76131 Karlsruhe, Germany (“Gameforge”).


    1. Eligibility, Participants and Participation

    (1) Participation in the contest is free. All users of full age resident in Europe or any member of the Commonwealth of Independent States (together the “participating areas”) who have a personal, active account according to the Standard Terms and Conditions of Use for tera.gameforge.com (hereafter “account”) are eligible to participate. Employees of Gameforge and companies associated with Gameforge, as well as relatives thereof, are allowed to participate but are excluded from receipt of any prizes.

    (2) A “participant” is any person entitled to participate as per (1) who participates as described in (3) between 5th June 2020 and 21st June 2020, 11:59 PM CEST (“participation period”).

    (3) The subject of the contest is the independent creation and submission of a digital artwork displaying clear relation to TERA during summer (“work”). The work must be submitted during the participation period in accordance with the following requirements (“entry”):

    a) The work must be submitted in .bmp or .psd format with dimensions of 1920x1080 pixels, 24-bit depth and a maximum file size of 6 MB, and must be unencumbered by third-party rights.

    b) The entry must be sent via the email address belonging to the account, using the subject line TERA Summer Contest to contest@tera-europe.com.

    c) The email should also include the participant’s character name, the server played on and the language played in, and also indicate how the participant wishes to be identified as the author of the work in its presentation and implementation (both in 2(2)), should they win. If the participant does not provide any indication of preference, they provide their general agreement that the provision of the character name, language version and server being played on is sufficient identification. Should the participant prefer to eschew any form of copyright identification, they may indicate as such in their entry.

    (4) Each participant is permitted only one entry. Entries submitted outside of the participation period as well as multiple entries, including entries linked to different accounts, will not be considered.


    2. Winners and Prizes

    (1) Gameforge will select a total of 10 works from amongst all eligible entries based on their respective creativity and originality by 23rd June 2020. The “winners” are those participants whose works Gameforge chooses.

    (2) In recognition of the winners’ creative achievements, Gameforge may present the submitted works on Gameforge’s internet and product pages (including online forums and Steam) and on their social network accounts on Facebook, Twitter and Instagram (together the “Gameforge sites”), providing the form of identification as per 1(3)(c) (“presentation”). Gameforge also reserves the right to give the winners’ works special recognition for their respective efforts by implementing them temporarily as loading screens in the online game TERA (“implementation”).

    (3) Gameforge will announce the winners by 23rd June 2020 via email, sent to the email address used for their entry (“notification”).

    (4) The winners will also receive the prizes mentioned in the contest announcement. The delivery of the prizes is planned from 13th July 2020 via a delivery service provide (“service provider”) commissioned by Gameforge, though as a result of the ongoing COVID-19 situation, the dispatch and/or delivery of the prizes may be delayed. Gameforge will ask the winners to provide a valid postal address (“address”) in a country within the participating areas in response to their notification by 30th June 2020, at the latest (“response”). Responses that Gameforge receives late or does not receive at all will lead to loss of entitlement to the respective prize.

    (5) The prizes are deemed to have been awarded to the winners by Gameforge with the handover of the prizes to the service provider. If a prize cannot be delivered due to the respective winner providing an incorrect address, any costs shall be borne by the winner.

    (6) A cash payment and/or payment of the prize in tangible assets as well as an exchange and/or transfer of the prizes to third parties are all excluded.


    3. Rights of Use and Indemnity

    (1) For the purpose of participation in the contest, Gameforge grants the participant the free-of-charge, non-exclusive right to use the required elements of the online game TERA to the necessary extent.

    (2) For the purposes of the presentation, the winners grant Gameforge the free-of-charge, non-exclusive and irrevocable right to use the respective work without limitation of time and place.

    (3) For the purposes of the implementation, the winners grant Gameforge the free-of-charge, non-exclusive and irrevocable right to use the respective work without limitation of place, for the time between submission and the end of the implementation.

    (4) In accordance with paragraphs 2 and 3, these include the rights of exploitation and reproduction, as well as the right to then make the work publicly available and grant usage rights to third parties, in so far as this is necessary within the context of the presentation and implementation.

    (5) By submitting their entry, the participant provides assurance that they produced the work themselves, guarantees that this does not infringe on the rights of third parties and indemnifies Gameforge against all claims from third parties based on the infringement of third-party rights in connection with the work.


    4. Data Privacy

    (1) Gameforge will collect the personal data provided by the participants (including user data for the account, i.e. the associated character name, email address, plus the address as provided by winners, and the form of copyright identification chosen per 1(3)(c)) in accordance with data protection requirements and process this exclusively for the purposes of running the contest. This includes checking eligibility for participation and adherence to the participation requirements, as well as, where applicable, the delivery of the prizes, the notification and the announcement of the winners using the copyright identification chosen as per 1(3)(c).

    (2) The personal data collected will initially be stored for the duration of the contest (including the period of the presentation and implementation) and then subsequently deleted. This excludes the identification chosen according to 1(3)(c) publicized as part of the presentation, which is stored permanently for reasons of transparency. To the extent that legal retention requirements stipulate longer-term storage, the affected data will be deleted at the latest following the expiry of such obligations.

    (3) Further information on the handling of personal data by Gameforge can be found within the Privacy Policy (see in particular point 3.9 for the holding of contests and the significant legal bases for the associated processing of this as well as point 6 on the rights of the affected person).


    5. Disclaimer

    Gameforge, its bodies, employees, and subcontractors are liable exclusively for wilful intent and gross negligence, regardless of legal basis, and in cases of ordinary negligence, only for the violation of essential contractual obligations and limited to foreseeable damages, as far as not precluded by other compulsory statutory provisions. These limitations do not apply for the loss of life, personal injury or damage to health.


    6. Final Provisions

    (1) The participant agrees to these Terms and Conditions by submitting their entry.

    (2) In addition to these Terms and Conditions, the Standard Terms and Conditions of Use also apply (together the “rules”).

    (3) Should a participant infringe upon the rules during the execution of the contest, or such an infringement be proven thereafter, Gameforge may revoke their eligibility to participate.

    (4) Gameforge reserves the right to end the contest before the end of the participation period, should an important reason arise. An important reason would in particular be if the proper execution of the contest cannot be guaranteed for technical or legal reasons.

    (5) The contractual relationship is governed by German law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods and the referral regulations of international private law. If the participant has as his usual domicile a location in another country within the European Union during the extent of the contest, the validity of the strictly applicable legal regulations of the country in question shall remain unaffected by the choice of law made in the prior sentence.

    (6) In the event that any individual provision of these conditions becomes ineffective, the remaining provisions shall remain effective and binding. The unenforceable provision shall be substituted for the relevant statutory provision.
